Terms of Service
These terms are an agreement between your business and Tapa, a service of JMK Technologies, Ghana ("Tapa", "we"). By creating an account you agree to them. If you don't agree, please don't use Tapa.
1. What Tapa does
Tapa is software that lets your business take orders, bookings and payments through WhatsApp. It includes a WhatsApp assistant (with optional AI), a dashboard, delivery tools and sales reports. Tapa provides the software only. Your business sells to your customers, prepares and delivers the goods or services, and is responsible for them.
2. Your account
- Give accurate details and keep your password safe. You're responsible for what happens under your login, including staff you share it with.
- You must be at least 18 and allowed to act for the business.
3. Free trial, plans and billing
- New accounts get a free trial (currently 14 days). No card is needed to start.
- After the trial, a paid plan is needed to keep the assistant answering customers. Prices are shown on the Billing page and may change with 30 days' notice.
- Plans are paid monthly in advance by Mobile Money or card through Paystack. Saved cards renew automatically until you remove them.
- If a payment is missed, there is a grace period (currently 7 days). After that the assistant pauses until you pay. Your data stays in your account.
- Fees already paid are not refunded, except where the law requires it.
4. WhatsApp, Meta and other services
- Tapa uses the WhatsApp Business Platform. You must follow WhatsApp's Business and Commerce Policies. Meta may charge for some messages; these charges are billed by Meta to the owner of the WhatsApp Business account unless we agree otherwise in writing.
- Customer payments go through your own Paystack account, under Paystack's terms. Tapa never holds your customers' money.
- Delivery links (for example Uber, Yango or Bolt) open those companies' services under their own terms.
5. Your responsibilities
- Keep your menu, prices, opening hours and availability correct. The assistant uses what you enter.
- Check orders and payments in your dashboard. The AI assistant can make mistakes; you're responsible for confirming orders with your customers when in doubt.
- Follow food safety, consumer protection, tax and other laws that apply to your business.
- Only message customers who contacted you or agreed to hear from you. No spam, scams, illegal goods, or anything WhatsApp's policies forbid.
- You are responsible for your customers' personal data that you collect through Tapa, as explained in our Privacy Policy.
6. Your data
Your menu, orders, customers and reports belong to you. You can download sales and expense records at any time. We use your data only to run and improve Tapa, as described in the Privacy Policy. If you close your account, we delete your business data within 90 days unless the law requires us to keep it longer.
7. Service availability
We work to keep Tapa running at all times but can't promise it will never be interrupted, for example during maintenance or if WhatsApp, Meta, Paystack or our hosting provider has a problem.
8. Liability
As far as the law allows, Tapa is provided "as is". We are not liable for lost profits, lost sales or indirect losses. Our total liability for any claim is limited to the fees you paid us in the three months before the claim.
9. Ending the agreement
You can stop using Tapa at any time; ask us to close your account by WhatsApp or email. We may suspend or close an account that breaks these terms or WhatsApp's policies, or that remains unpaid.
10. Changes and law
We may update these terms and will tell you about important changes in the dashboard or by WhatsApp or email. These terms are governed by the laws of Ghana.
